Terms of Sale

Last updated: 07/10/2026 — This English version is a translation; the French version prevails.

1. Who we are

The website www.fondationsfondations.com is operated by BUREAU FONDATIONS, a French SARL with a share capital of €1,000, Paris Trade Register 939 543 401, VAT FR44 939 543 401, registered office 58 rue de Monceau, 75008 Paris, France, managing directors Nastassja Bonnabel & Mario Guay, trading as Fondations ("we"). Contact: bonjour@fondationsfondations.com.

These Terms apply to purchases made on the website by private individuals (the "Customer"). Professionals and retailers are subject to separate terms, available on request. Placing an order means accepting the Terms in force on the date of the order.

2. Our products

2.1 Our candles are poured in small batches using plant-based waxes. The following are characteristics of the product, not defects: variations in colour, finish and scent intensity from one piece to another, "frosting" (a whitish bloom on the surface), superficial cracks in the wax, and slight separation of the wax from the container.

2.2 Scent. Scent perception is personal and varies with the size and ventilation of the room. A scent that does not suit the Customer's taste is not a defect; the right of withdrawal (section 5) exists for that.

2.3 Burn time. The stated burn time is an average obtained by following our instructions: a first burn of at least three hours, then never more than four hours at a time, wick trimmed before each use. Other use shortens it.

2.4 Safety. The Customer follows the instructions on the product and its packaging. We are not liable for damage caused by use contrary to these instructions, unless the damage results from a defect in the product.

2.5 Safety information and labelling.

Our products come with the applicable instructions for use and safety information in French and English. Essential use and safety information is also available on the product pages.

Before ordering for a destination where applicable regulations require information in a specific language, the Customer may contact us at bonjour@fondationsfondations.com. We will indicate the information available and, where necessary and possible, provide a translation of the safety instructions.

We reserve the right to decline, or to cancel and fully refund, an order where the regulatory requirements applicable at the destination cannot be met.

3. Orders and payment

Prices are shown in euros, including VAT where applicable, excluding delivery charges displayed before payment. The order becomes final once payment is confirmed. A confirmation email is then sent to the Customer, with a link to these Terms and Conditions of Sale, including the withdrawal form in Appendix 1.

We may cancel an order and refund it in full in the event of an obvious pricing error, an undetected stock shortage, reasonable suspicion of fraud, quantities clearly inconsistent with personal use, in particular for unauthorised resale, or where a regulatory or logistical constraint specific to the destination country prevents the order from being fulfilled.

Pre-orders. The latest delivery date applicable to pre-orders is shown on the product page. If we cannot meet it, we will inform the Customer, who may choose either to keep the order until the new proposed date or to obtain a full refund of the amounts paid.

4. Delivery

Orders are prepared and dispatched from France to mainland France and European Union countries. Delivery charges, available options and estimated delivery times are displayed before the order is confirmed.

Two delivery methods are offered: delivery to a Mondial Relay pickup point, chosen by the Customer after payment, or home delivery by Colissimo (with signature for the European Union). Delivery is complimentary on orders over €285 in mainland France and in eligible destinations within the European Union. A tracking number is provided to the Customer as soon as the order is dispatched.

Delivery times. Delivery times displayed at checkout are estimates and may vary depending on the carrier, peak periods, customs checks or any event beyond our control. Unless a different date or period is expressly stated at the time of order, in-stock orders are delivered no later than 15 business days after the order in mainland France and the European Union. If delivery is late beyond this period, the Customer may ask us to deliver within a reasonable additional period and, failing that, terminate the contract and obtain a refund of the amounts paid, under Articles L216-6 et seq. of the French Consumer Code.

Taxes and customs. Orders shipped within the European Union are not subject to import customs duties. Applicable taxes are calculated in accordance with current regulations and displayed at checkout.

For orders shipped outside the European Union, customs duties, local taxes, import VAT and clearance fees may be charged on arrival. Unless expressly collected at checkout, these amounts are not included in the product price or delivery charges and are the recipient's responsibility.

If delivery is refused or amounts due on import are not paid, the costs actually incurred for return, storage, redelivery or abandonment of the parcel may be deducted from the refund, within the limits permitted by applicable law.

Damaged parcel or broken product. Products are transported at our risk until they are handed over to the Customer. To allow us to open a claim with the carrier, the Customer is asked to report any damage as soon as possible and, if possible, within 14 days of delivery, with photographs of the outer parcel, the shipping label, the inner packaging and the products concerned. This request does not limit the Customer's statutory rights. Depending on the circumstances, we will offer a replacement, a refund or any other appropriate solution. The broken product does not need to be returned unless we expressly request it.

5. Right of withdrawal

The consumer Customer has 14 days from receipt of the products to exercise the right of withdrawal, without giving any reason. The Customer may notify us by email at bonjour@fondationsfondations.com or using the form in Appendix 1.

The Customer returns the products without undue delay and no later than 14 days after communicating the decision to withdraw. Except in the case of an error on our part or a defective or non-conforming product, the direct cost of return is borne by the Customer. Returns must be sent to the address provided after receipt of the withdrawal request.

Products must be returned complete, with their accessories and protective elements, in packaging suited to their fragile nature. We recommend tracked and insured shipping. The Customer is liable for any diminished value of the products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

A candle that has been lit, used, or whose wax has been altered may no longer be resaleable. Depending on its condition, a deduction proportionate to the diminished value observed may be applied to the refund; in some cases, this diminished value may amount to the full price of the product.

We refund all amounts received for the order concerned, including the cost of the standard delivery method offered, without undue delay and no later than 14 days after notification of withdrawal. We may withhold the refund until we have received the products back or until the Customer has supplied proof of having sent them, whichever is earlier. The refund is made using the same payment method as for the order, unless the Customer expressly agrees otherwise. Any supplement paid by the Customer for a delivery method more expensive than the standard method offered is not refunded.

For partial returns, initial delivery charges are refunded only to the extent that they would have been avoided had the returned products not been included in the order, in accordance with applicable law.

The right of withdrawal does not apply to products made to the Customer's specifications or clearly personalised.

6. Legal guarantees

Products are covered by the legal guarantee of conformity and the guarantee against hidden defects, under the conditions set out in Appendix 2 of these Terms.

If a product is defective, non-conforming or damaged on delivery, the Customer may contact us at bonjour@fondationsfondations.com, stating the order number and attaching, where possible, photographs of the product, its packaging and the shipping label. Depending on the case, we will arrange repair, replacement, refund or any other measure provided for by applicable law.

The artisanal characteristics expressly described on the product pages and in section 2 of these Terms, such as slight variations in colour, finish or scent intensity, frosting, superficial cracks in the wax or slight separation of the wax from the container, do not constitute a lack of conformity, provided they do not affect the product's fitness for its normally expected use. Normal wear and damage resulting from use contrary to the safety instructions are not defects, unless the damage results from a defect in the product.

7. Liability and force majeure

We are not liable for any failure caused by the Customer, by the unforeseeable and unavoidable act of a third party, or by force majeure within the meaning of Article 1218 of the French Civil Code, such as a carrier strike, a natural disaster or a supply interruption meeting those criteria. Our obligations are then suspended; beyond 30 days, either party may cancel the order and the Customer is refunded.

8. Disputes

These Terms and Conditions of Sale are governed by French law, without depriving a consumer Customer residing in another country of the mandatory protective provisions applicable in their country of residence.

In the event of a complaint, the Customer is invited to contact us first at bonjour@fondationsfondations.com in order to seek an amicable solution. Failing an amicable resolution, the competent courts are determined in accordance with applicable legal rules.

9. Miscellaneous

Our processing of personal data is described in our Privacy Policy. The texts, images, logos and creations on the website belong to us and may not be reused without our written consent. If any clause is held invalid, the others remain in force. In the event of any discrepancy with a translation, the French version prevails.

APPENDIX 2 — STATUTORY GUARANTEES

Translation of the statutory notice required by French law. The French text in Appendix 2 of the French version prevails.

The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish the existence of the lack of conformity, not the date on which it appeared.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair but the seller imposes replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and receive a full refund against return of the goods, if:

1. the seller refuses to repair or replace the goods;

2. repair or replacement takes place after thirty days;

3. repair or replacement causes major inconvenience to the consumer;

4. the lack of conformity persists despite the seller's unsuccessful attempt to remedy it.

The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement first. The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are returned.

These rights result from Articles L217-1 to L217-32 of the French Consumer Code.

A seller who in bad faith obstructs the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
